1) Agreement to Terms

By accessing and using ViHertz ("the Service"), you accept and agree to be bound by these Terms. ViHertz is operated by VIASERIES PREMIER LLP (LLPIN: ACB-1937). We may update these Terms periodically.

If you do not agree to these Terms, please do not use the Service.

2) Service Description

ViHertz is a music streaming app that streams publicly available content using the official SoundCloud API. Key points:

• • Streaming only: ViHertz does not host, upload, or distribute music files and does not provide downloading of ViHertz‑streamed music.
• • Offline Player plays only audio files already stored locally on your device (not ViHertz streams).
• • Use of SoundCloud-hosted content is also governed by SoundCloud’s Terms of Use and policies.
• • Users can earn loyalty points for listening and redeem them as per program rules.

You agree to use the Service in compliance with applicable laws and SoundCloud’s Terms of Use.

3) User Accounts

Authentication is via Google Sign-In. We do not collect your password. You may update your phone number later on your profile page. You are responsible for:

• • Providing accurate and complete registration information
• • Maintaining the confidentiality of your account credentials
• • All activities that occur under your account
• • Notifying us immediately of any unauthorized use

You must be at least 13 years old to create an account. Users under 18 must have parental consent. You may request account deletion within the app at any time.

4) Acceptable Use

You agree not to use ViHertz for any unlawful purpose or in any way that could damage, disable, or impair the service. Prohibited activities include:

• • Attempting to download, capture, or cache ViHertz-streamed content for offline use
• • Attempting to circumvent security measures or access restrictions
• • Using automated systems to access the service
• • Sharing account credentials with multiple users
• • Uploading malicious code or attempting to harm our systems
• • Infringing third-party rights; you must comply with SoundCloud and other applicable third-party terms when accessing content

5) Monetization & Subscriptions

ViHertz is free to use for streaming public SoundCloud content. Optional Premium ("Pro") plans are available for AI-based features and personalization. Subscriptions do not provide ad‑free music or paid access to SoundCloud content.

6) Loyalty Points

Users may earn points for listening activity. Points have no cash value and can be redeemed only as described in the app. We may modify or discontinue the program at any time.

7) Intellectual Property

Music streamed via ViHertz remains the property of the respective creators and is hosted by SoundCloud. ViHertz and VIASERIES PREMIER LLP make no claim of ownership over third‑party content. Our trademarks, logos, app design, and original features remain our property. You may not:

• • Copy, distribute, or modify any content without proper authorization
• • Use our trademarks or brand elements without permission
• • Reverse engineer or attempt to extract source code

8) Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. Please review our Privacy Policy to understand our practices.

9) Termination

We may terminate or suspend your account and access to ViHertz at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

10) Disclaimer and Limitation of Liability

ViHertz is provided "as is" without warranties of any kind. We do not guarantee availability, quality, or uninterrupted access to third‑party content hosted on SoundCloud. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages.

11) Prohibited Activities

Users must not engage in activities that violate these Terms, applicable law, or third‑party policies:

• • Attempt to download, capture, or redistribute SoundCloud content streamed through the App
• • Use the App for unauthorized commercial purposes
• • Circumvent API restrictions or platform (Play Store/App Store) policies
